TRANSITIONAL JUSTICE IN THE AFTERMATH OF DICTATORSHIP THE CASE OF LIBYA

Abstract

This study examines the nexus between transitional justice in Libya and the challenges related to the state functions and institutions. The aim of this study is to explain most of the multifaceted challenges that the Gadhafi regime created, reinforced, and resurfaced in the aftermath of Gadhafi's overthrow. To investigate this matter, this study will examine the extent to which non-functioning state institutions, political divisions, tribal ties, and ideological differences prevent the implementation of transitional justice. In addition to regional and international factors and their interventions in Libya affecting the course of the political process. The methodology is a qualitative research approach based on a desk study and literature review to explore and understand transitional justice challenges before and after the Gadhafi revolution to examine the state founded by Gadhafi. The approach consists of integrating the historical analysis of the Qaddafi regime with the theoretical framework of conflict, reconciliation, and transitional justice to define its different concepts of moving from theoretical concepts to practical reality in the Libyan reality related to national reconciliation and transitional justice. After moving practically to the Libyan reality, this study relies on the analysis of the Libyan political realities to understand the dynamics of the conflict, its roots, obstacles to its resolution, and the factors associated with it. Hence, the reality of transitional justice and its prospects in Libya are analyzed. This study aims to identify the challenges of transitional justice in Libya. This study reveals that the challenges are the product of the unique state founded by Gadhafi, and the challenges of transitional justice are exacerbated by being affected by the challenges brought by the revolution to overthrow Gadhafi and associated with external interventions that negatively affected the Libyan conflict.
