Abstract

Methodologically, the study undertakes a comparative documentary analysis of statutory provisions and authoritative Maliki texts across four domains: nafaqah, the employment-maintenance nexus, guardianship contingencies, and enforcement mechanisms. It develops a fourfold typology of legal gaps, omission, ambiguity, enforcement vacuum, and assumption failure, treated as analytically constitutive features of the legal corpus. The analysis is limited to the structural and doctrinal conditions through which entitlements are constituted and mediated, rather than their empirical realisation.
