Artificial Intelligence and Privacy Violation from a Jurisprudential Perspective

Abstract

Technological advancement stands as a cornerstone of modern global society, transitioning from analog to digital realms. Within this shift, artificial intelligence (AI) has emerged as a dominant force shaping contemporary activities. While AI has greatly contributed to problem-solving and stability, its prevalent use also raises significant concerns regarding privacy infringement. This research investigates the ways AI compromises privacy rights and explores the resultant negative impacts. Furthermore, it seeks to identify Islamic jurisprudential measures to mitigate these effects. Utilizing a mixed methodology, this study employs both descriptive and analytical approaches. It delineates the characteristics of AI, types of privacy, and their interrelation, while scrutinizing Islamic jurisprudential texts for viable solutions. The findings underscore the substantial risks AI poses to individuals’ privacy and society. Moreover, this study identifies Shariah principles as potent tools for addressing AI-induced privacy challenges.
