Abstract

The system of endowment in Islam is one of the leading systems that have significant impact on the development of Islamic civilization and the renaissance of the Muslim nation in different eras of the past. What distinguishes this unique system from others is that it is established, managed and financed by members of the Islamic community and its institutions, away from central authorities and governments._x000D_ This magnificent system, through its long history, touched all aspects of humanity such as the religious, scientific, cultural, health, social and others. It also had an effect on the everyday necessities and general amenities._x000D_ However lately, since the modern state took over affairs and administration of the Islamic endowment system, its role has declined, its roots have been eroded, and its effectiveness has diminished._x000D_ This thesis attempts to identify the most important administrative and legal issues that led to the diminishing role of the endowment system and the weakness of its social effectiveness. It analyzes the effects of these problems in order to find solutions that will restore the spirit and significance of the Islamic endowment system disappeared recently._x000D_ The first of the issues discussed in this thesis is the state control over the endowment and its negative effects that have led to its decline._x000D_ The thesis also examines the causes and manifestations of the demise of the endowments system despite its establishment on two important principles: perpetuation and endless support received through benefactors and financiers, which comes as a result of Islam urging charity in general and establishing charitable trust in particular._x000D_ The purpose of this study is to clarify the need for the Islamic endowment system to remain a civil society organization that is independent of the control of governments, states and political entities, and to urge reform and amendment of the endowment laws that led to its present failure.The research also aims to raise awareness about this system, encouraging bodies and institutions, such as scholars, preachers and other educated groups, in addition to the Ministry of Endowment, to stress its importance through all available means.
